Terms & Conditions
Updated August 12, 2026
1. Agreement and Acceptance
These Terms and Conditions ("Terms") govern your purchase of goods and services from Vortex Australia, operated by Camillus Rodrigo ("we", "us", "our"). By placing an order through our website, you agree to be bound by these Terms, our Privacy Policy, and our Cookie Policy. If you do not agree with any part of these Terms, you must not complete a purchase.
We reserve the right to update these Terms at any time without prior notice. The version of the Terms in effect at the time your order is accepted will apply to that transaction. We encourage you to review these Terms periodically to stay informed of any changes.
2. Products and Specifications
We take reasonable care to ensure that product descriptions, specifications, and images on our website are accurate and current. However, we do not warrant that descriptions are error-free, and actual products may vary slightly in appearance due to differences in lighting, display calibration, and manufacturing tolerances.
Technical specifications including suction power (measured in Air Watts), runtime (measured in minutes under standard test conditions), bin capacity (measured in litres), and weight (measured in kilograms) are based on manufacturer testing protocols. Real-world performance may vary depending on usage patterns, environmental conditions, and battery age. We reserve the right to modify product specifications without prior notice, though we will notify customers of material changes before shipment where practicable.
3. Ordering Process
Our website displays products available for purchase along with current pricing and stock availability. Placing an item in your shopping cart does not constitute an offer or acceptance; it is merely an indication of your intent to purchase. A contract for sale is formed only when we dispatch your order and send a dispatch confirmation email.
We reserve the right to refuse or cancel any order at our discretion, including but not limited to orders with suspected fraudulent payment details, orders that appear to be placed for commercial resale, or orders where pricing errors have occurred. In such cases, we will notify you promptly and refund any amounts charged to your payment method.
4. Pricing and Payment
All prices are quoted in Australian Dollars (AUD) and include Goods and Services Tax (GST) at the current rate of 10% where applicable. Prices do not include delivery charges, which are calculated at checkout based on your delivery address and selected shipping method.
We accept major credit cards including Visa, Mastercard, and American Express. Payment is processed at the time your order is dispatched. All transactions are processed through PCI-DSS compliant payment gateways, and your card details are never stored on our servers. We reserve the right to request additional verification for high-value orders or orders placed with new customer accounts.
5. GST and Tax Invoices
As a registered entity supplying goods to Australian consumers, we issue tax invoices that comply with Australian Taxation Office (ATO) requirements. A tax invoice will be included with your dispatched order and also sent to your registered email address. If you require a replacement tax invoice for accounting purposes, please contact our support team with your order number.
For business customers purchasing in volume for commercial purposes, we can issue ABN-compliant invoices upon request. Please provide your Australian Business Number at the time of ordering to ensure correct documentation.
6. Delivery and Risk
Standard delivery to Australian metropolitan addresses typically takes 3-5 business days from dispatch. Regional and remote deliveries may take 5-10 business days depending on your location and carrier availability. Delivery estimates are provided in good faith but are not guaranteed; actual delivery times may vary due to carrier performance, weather conditions, public holidays, or other factors beyond our control.
Risk of loss or damage to goods passes to you when the goods are delivered to the address you specified. Title to the goods remains with us until we have received payment in full. If your goods are damaged in transit, please notify us within 48 hours of delivery with photographic evidence so that we can initiate a claim with the carrier and arrange replacement or refund.
7. Consumer Guarantees under Australian Consumer Law
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
These consumer guarantees apply in addition to any express manufacturer's warranty provided with the product. Nothing in these Terms limits, excludes, or modifies your rights under the Australian Consumer Law to the extent that such rights cannot be lawfully limited, excluded, or modified.
8. Manufacturer's Warranty Against Defects
In addition to your rights under the Australian Consumer Law, our products come with a 2-year manufacturer's warranty against defects in materials and workmanship from the date of purchase. This warranty covers repair or replacement of defective components at no charge, provided the product has been used in accordance with the manufacturer's instructions.
To claim under the manufacturer's warranty, you must provide proof of purchase and contact our support team. The warranty does not cover damage resulting from misuse, accident, unauthorised modification, use with incompatible accessories, or normal wear and tear of consumable components such as filters and brush heads.
9. Change of Mind Returns
If you change your mind about a purchase, you may return the product within 30 days of delivery for a refund or exchange, provided the product is in its original condition, unused, and with all original packaging and accessories intact. Return shipping costs for change of mind returns are borne by you unless the product was incorrectly described on our website.
To initiate a change of mind return, contact our support team to obtain a Return Merchandise Authorisation (RMA) number. Products returned without an RMA number may be refused or subject to an administrative handling fee. Refunds will be processed to your original payment method within 14 days of us receiving and inspecting the returned product.
10. Faulty Products
If you receive a faulty product or a product that does not match its description, please contact us within 30 days of delivery. Under the Australian Consumer Law, you are entitled to choose between a repair, replacement, or refund for a major failure, or a repair or replacement for a minor failure. We will cover the cost of returning faulty products.
When reporting a fault, please provide your order number, a detailed description of the issue, and where possible, photographic or video evidence. We aim to respond to fault reports within 2 business days and will work with you to resolve the issue as quickly as possible.
11. Limitation of Liability
To the maximum extent permitted by law, we exclude all conditions, warranties, and other terms that might otherwise be implied by statute, common law, or the law of equity. Our liability for any claim arising from the sale of goods is limited to the purchase price of the goods in question.
We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or business opportunities, arising from your use of our products or website, even if we have been advised of the possibility of such damages. This limitation applies to all causes of action, whether based on contract, tort, negligence, strict liability, or any other legal theory.
12. Indemnification
You agree to indemnify, defend, and hold harmless Camillus Rodrigo, its directors, officers, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with: your access to or use of our website; your violation of these Terms; your infringement of any third-party rights; or your misuse of our products.
13. Force Majeure
We will not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from events beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemics, war, terrorism, civil unrest, strikes, lockouts, industrial action, supply chain disruptions, government actions, or failure of utilities or telecommunications networks.
If a force majeure event continues for more than 30 days, either party may terminate the contract by written notice to the other party. In such cases, we will refund any pre-paid amounts for goods that cannot be delivered due to the force majeure event.
14. Intellectual Property
All content on our website, including text, graphics, logos, images, audio clips, and software, is the property of Camillus Rodrigo or its licensors and is protected by Australian and international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, display, perform, or create derivative works from any content on our website without our prior written consent.
Product names, brand names, and logos are registered trademarks of their respective owners. Our use of these marks is for identification purposes only and does not imply endorsement by or affiliation with the trademark owners unless expressly stated.
15. Links to Third-Party Sites
Our website may contain links to third-party websites for your convenience. We do not control, endorse, or assume responsibility for the content, privacy policies, or practices of any third-party websites. Your use of third-party websites is at your own risk, and we encourage you to review the terms and privacy policies of any third-party site you visit.
16. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions will continue in full force and effect. The invalid provision will be deemed modified to the minimum extent necessary to make it valid, legal, and enforceable while preserving its original intent.
17. Governing Law and Jurisdiction
These Terms are governed by the laws of New South Wales, Australia, and the Commonwealth of Australia. You submit to the non-exclusive jurisdiction of the courts of New South Wales and the courts competent to hear appeals from them. Nothing in these Terms affects your statutory rights as a consumer under the Australian Consumer Law, which apply regardless of the governing law clause.
